Government Office Delay M&S Decision

As councillors and supporters of the  Marks and Spencer development in Hayle turned up to what they expected to be a meeting at which the future of the proposed new store would be decided, it became clear that no decision was going to be made.

The reason for the further delay in the project had been caused this time by the intervention of the Government Office for the South West (GOSW) who had, at the 11th hour, contacted the council and invoked their right to intervene and instructed Penwith District Council that it could not grant planning permission without first receiving the specific approval from GOSW. This was to give them time to consider if the application should be 'called in' for determination by the Secretary of State.

The meeting at Penwith went ahead, though in accordance with the GOSW directive, no decision was made. However it was agreed that Penwith Council would grant conditional approval for the Marks and Spencer scheme, if and when GOSW allows the Council to do so, subject to the developer making a satisfactory contribution to road and access improvements to the site.

A decision on whether or not the Plan will be 'called in' is expected within a month, if the decision is made to take the decision out of Penwiths' Hands and for the Secretary of State to determine the decision then there could be further substantial delays and a Public Enquiry may be required.
