Bid to make land a 'Green'

Hayle Councillor John Bennet is leading a campaign to have the land which runs down from the Railway Station, behind Penpol Terrace, to the Swing Bridge designated as a village green.

In order to to register land as a village green under the Commons Registration Act 1965 John is asking for your help. John is hoping to provide evidence that  the area leading from the swing bridge to the railway station has and continues to be used for 'recreational purposes' by local people and that they have done so without permission, without being stopped or seeing notices which stop them, and without being secretive about it, and that between them they have done this for a continuous period of 20 years. 'Recreational Purposes' can be anything from walking (with or without a dog), playing games, picnicing or indeed any other legal activity or pastime.

If the facts are proven there is no discretion and the County Council must register the land as a village green which will give it legal protection from most forms of development and people can continue to enjoy lawful pastimes on it.

Initial investigations have shown that local people have indeed used the land for recreational purposes since 1982 when the railway track was removed, the case is further enhanced by the fact that in early 1990s the area was landscaped as a public area by Kerrier Groundworks funded by the European Social Fund.

What John needs now are as many people as possible to sign a declaration stating that they have used the area over the last 20 years.

If you are able to help in any way then John will be delighted to hear from you. He can be contacted on (01736) 753184 or by email jb@john-bennett.com
